2C:14-3. Aggravated Criminal Sexual Contact

This is a 3rd degree crime which a defendant can be charged in addition to being charged with aggravated sexual assault.

AGGRAVATED SEXUAL ASSAULT

2C:14-2. Aggravated Sexual Assault

This is a first degree crime. Aggravated sexual assault is an act of sexual penetration with another person under any of the following circumstances:

  • The victim is less than 13.
  • TThe victim is at least 13 but less than 16, and the defendant is related to the victim
  • The actor was in charge of watching or taking care of the victim.
  • The act is committed during a violent crime.
  • The actor is armed with a weapon.
  • The actor is helped by another person and uses physical force or coercion.
  • The actor uses physical force and causes severe personal injury.
  • The victim was physically helpless or mentally challenged.

2C:14-3b. Criminal Sexual Contact

This is a 4th degree crime which a defendant can be charged in addition to being charged with sexual assault.

LEWDNESS

2C:14-4. Lewdness

Lewdness is committing a flagrantly lewd and offensive act which a person knows is likely to be observed by other non-consenting persons who would be affronted or alarmed. The most common example is exposing your genitalia to another non-consenting person. Lewdness is a disorderly persons offense unless the victim is less than 13 and the defendant is at least four years older or when the victim is mentally handicapped, in which case lewdness is a 4th degree crime.

Convictions for sex crimes are very serious. Sentences for sex crimes may include steep fines, mandatory minimums, psychosexual evaluations, counseling, probation, and even community supervision for life also known as Megan’s Law. SEXUAL ASSAULT

2C:14-2b. Sexual Assault.

2nd degree sexual assault in New Jersey occurs in one of two ways:

  1. The defendant commits an act of sexual contact with a victim who is less than 13 years old and the defendant is at least four years older than the victim; or
  2. The defendant commits an act of sexual penetration under any of the following circumstances:
    • The defendant uses physical force or coercion but the victim does not sustain any severe personal injury;
    • The victim is on probation, parole, or confined to a hospital and the defendant is in charge of or watching or caring for the victim;
    • The victim is at least 16 but less than 18 and the defendant is related to the victim, or the defendant is in charge of, or taking care of or watching the victim; or
    • The victim is at least 13 but less than 16 years old, and the actor is at least four years older than the victim.

The law defines sexual penetration as vaginal intercourse, anal sex, oral sex, or the insertion of the hand, finger or object in the anus or vagina by the defendant or upon the defendant’s instruction.

The law defines sexual contact as the intentional touching by the victim or defendant, either directly or through clothing of the victim’s or defendant’s intimate parts, including genitals, genital area, anal area, inner thigh, groin, buttocks, or breast, for the purpose of degrading or humiliating the victim, or sexually arousing or sexually gratifying the defendant.
